Who we are

8thElement Digital Inc is an AI implementation and operations firm with offices in Monroe, New Jersey and Hyderabad, India. In this policy, “we” and “us” mean 8thElement Digital Inc. This policy covers this website. It does not cover work we carry out inside a client’s own systems, which is governed by the agreement with that client.

What we collect

Information you give us

If you use the contact form or the chat on this site, we collect the details you enter: your name, work email address, telephone number, the company you work for where you tell us, and anything you write in the message. We ask for a work email address because we reply only to business enquiries.

Information collected automatically

Our hosting provider records standard technical information when you visit, including your IP address, browser type, the pages you view and the time of your visit. This is used to keep the site running and secure. The site also loads fonts from Google and a security check (Google reCAPTCHA) on the final step of the chat, which means Google receives your IP address and basic technical information. Google acts as an independent controller for that data under its own privacy policy.

What we do not collect

We do not sell personal information, we do not use it for advertising, and we do not add you to a marketing list because you used the chat. We do not knowingly collect information from anyone under 18.

Why we use it, and on what legal basis

• To answer your enquiry. Legal basis: your consent when you submit the form, and our legitimate interest in responding to business enquiries.
• To keep the site secure and working. Legal basis: our legitimate interest in protecting the site from abuse and diagnosing faults.
• To meet legal obligations, including keeping records where the law requires it.

Who can see it

Enquiries are visible to the people at 8thElement who handle them. We also use a small number of service providers who process data on our behalf: our website host and form provider (Netlify), our email provider, and Google for the font delivery and security check described above. We may disclose information where the law requires it, or to protect our rights. We do not otherwise share your details with third parties.

Where it is held, and for how long

Enquiry details are held on servers in the United States and are accessible to our teams in the United States and India. Where personal data is transferred out of the UK or European Economic Area, we rely on the standard contractual clauses approved for that purpose. We keep enquiry details for as long as we are in contact with you about the enquiry and for up to 24 months afterwards, then delete them, unless we have an ongoing business relationship or a legal reason to keep them longer.

Your rights

Depending on where you live, you may have the right to ask us for a copy of the personal information we hold about you, to correct it, to delete it, to restrict or object to how we use it, and to receive it in a portable form. If you are in California, you may also ask what categories of personal information we collect and request deletion, and we will not discriminate against you for asking. We do not sell or share personal information as those terms are defined under California law.

To make a request, email info@8thelement.ai. We will respond within the time the law allows, normally within 30 days. If you are in the UK or the European Economic Area and are not satisfied with our response, you may complain to your local data protection authority.

Cookies

This site does not set advertising or tracking cookies. Your browser may store small amounts of data needed for the site to work. If we introduce analytics or other non-essential cookies in future, we will publish a cookie notice and ask for your consent before they are set.

Security

We use appropriate technical and organisational measures to protect personal information, including encryption in transit, access controls and supplier due diligence. No website can be completely secure, so please do not send sensitive personal information, such as health or financial details, through the contact form or chat.

If we change this policy we will update the date at the top of this page. Material changes will be highlighted on this page.
